Advisory For Housing categorized as Lead-Abated:
Housing units listed in this category on the Registry have all undergone abatement treatments to
control or eliminate lead-based paint hazards. This may mean only hazards were treated or could mean
all lead-based paint (both hazardous and intact) was abated. Abatement means that the leaded surfaces
and/or components were treated using a method designed to last at least 20 years.
Methods of lead abatement include: paint removal (chemical stripping or wet scraping), enclosure,
component replacement or encapsulation. At the completion of lead abatement work, all units achieved
the clearance standards in effect at the time, as promulgated by the USEPA and adopted by the State of
New Jersey under its Lead Hazard Evaluation and Abatement Code, N.J.A.C. 5:17.
Unless the lead-based paint was removed or the leaded components/surfaces were replaced with new
components/surfaces there is the potential that lead-based paint can reemerge as a hazard unless the
owner has taken steps to insure the integrity of the lead treatments remains intact. Therefore, no
warranty can be made as to the current level of lead-safety of paint, household dust or soil.
Advisory For Housing categorized as Lead-Hazard Controlled:
Housing units listed in this category on the Registry are (1) subject to and have complied with the
provisions of 24 CFR Part 35, Lead-Based Paint Poisoning Prevention in Certain Residential Structures, or
(2) have passed a five-year cyclical state inspection in accordance with N.J.A.C. 5:10-6.6, Lead-safe
maintenance requirements for multiple dwellings, which became effective May 16, 2005. Given the
effects of normal deterioration or the effects of conducting activities such as repair work that disturb
paint, no warranty can be made as to the current level of lead-safety of paint, household dust or soil.
Advisory For Housing categorized as Lead Free:
Housing units listed in this category on the Registry are (1) Verified as having been constructed on or
after January 1, 1978; or (2) Certified to be lead-free by a licensed NJ lead evaluation firm. Verification of
year of construction is based upon public records such as those maintained by a local tax assessor's
office. Lead Free Certificates are based upon XRF inspections performed in accordance with N.J.A.C.
5:17 Lead Hazard Evaluation and Abatement Code.
Advisory For Housing categorized as Lead Free Interior:
Housing units listed in this category on the Registry are Certified to have a lead-free interior by a
licensed NJ lead evaluation firm. Lead-Free Interior Certificates are based upon XRF inspections
performed in accordance with N.J.A.C. 5:17 Lead Hazard Evaluation and Abatement Code.
Advisory For Housing that is not listed in the Registry:
No conclusions may be drawn concerning the lead-safe status of any housing that does not appear in
the Registry. Note that the Department of Community Affairs makes every effort to ensure the accuracy
of this list. It is, however, intended only as a guide, and it is incumbent upon a prospective tenant or
buyer to request and review the lead-safe documentation in the possession of the landlord or the seller
as to the lead-safe status of any particular housing unit before making any decisions.
